TERMS AND CONDITIONS

Overview

Welcome to The Rose Garden! These Terms & Conditions (“Terms”) outline the guidelines for using our boutique, venue, and related services. By visiting our location, browsing our website, or booking any service, you agree to comply with these Terms.

Our goal is to create an enjoyable, transparent, and personalized experience for every client — from your first visit to the final fitting or event day.

Appointments & Walk-Ins

Walk-ins are always welcome! However, booking an appointment ensures a more personalized experience with Clara Henry’s undivided attention and any requested dresses or venue setups prepared in advance.

  • Appointment requests can be made online or by contacting us directly.

  • Appointment times are confirmed once you receive a written or digital confirmation.

  • We kindly ask for a 24-hour notice if you need to reschedule or cancel.

Dress Orders & Customizations

To provide the best fit and design experience:

  • A deposit or full payment may be required to begin an order.

  • All custom, made-to-order, and altered items are final sale and non-refundable.

  • Production and delivery timelines vary by designer. We recommend ordering 4–6 months in advance of your event date.

  • Minor variations in color or style may occur based on designer availability and fabric updates.

Venue Reservations & Event Policies

Booking the venue secures your selected date and time:

  • A $500 non-refundable deposit is required to reserve your event date.

  • A refundable damage deposit is required and will be returned within 7–10 business days after the event if no damages occur.

  • Final guest counts, catering details, and layout preferences must be confirmed no later than 30 days before your event.

  • Outside vendors must be approved by The Rose Garden management prior to the event.

Payments & Cancellations

  • Payments can be made via approved methods listed at checkout or during booking.

  • All deposits are non-refundable unless otherwise stated in writing.

  • Cancellations within 30 days of the event or order completion date may be subject to additional fees to cover preparation costs.

Liability & Damages

Clients are responsible for any damages to The Rose Garden’s property, décor, or furnishings caused by themselves, their guests, or vendors during the event or fitting.

The Rose Garden is not liable for lost, stolen, or damaged personal items brought onto the premises.

Privacy Policy

Your privacy is important to us. Personal information collected through our website, booking system, or in-store visits will only be used to manage your order, event, or communication preferences. We never sell or share personal information with outside parties.

Policy Updates

The Rose Garden reserves the right to update these Terms & Conditions as needed. Changes will be reflected on this page, with the most recent update date listed below.

Last Updated: October 2025

Designer Credit & Image Use

The images, models, and dresses featured on The Rose Garden’s website and marketing materials are intended solely to showcase the styles, quality, and types of dresses available through our boutique.

All designer gowns are sourced directly from the designers themselves, and we do not claim ownership or creation of these designs. Each image accurately represents what clients can find and order through The Rose Garden as an authorized retailer.

All professional and stock images used on our website are licensed for commercial use and documented on file. The Rose Garden and Clara Henry do not take creative credit for any designer’s work or imagery, and any mention of specific brands or designers is purely for informational and representative purposes.

Liability Waiver & Indemnification

By visiting, booking, or hosting an event at The Rose Garden, all clients and guests agree to release and hold harmless The Rose Garden, its owners (including Clara Henry), employees, and contractors from any liability for injury, property damage, or loss that may occur on the premises.

Clients are responsible for ensuring the safety and appropriate conduct of their guests and vendors during all events, fittings, and appointments.

If any claim or dispute arises from the actions of the client, their guests, or hired vendors, the client agrees to indemnify and defend The Rose Garden and Clara Henry against any related expenses, damages, or legal fees.

Vendor & Third-Party Services Disclaimer

While The Rose Garden may recommend preferred vendors (such as caterers, photographers, or DJs), all external vendors operate as independent third parties.

We are not responsible for their actions, performance, or services. Clients are encouraged to review all contracts directly with any third-party vendors before booking.

Conduct & Property Care

We take pride in maintaining a beautiful and welcoming environment. To ensure the comfort of all clients and guests:

  • Smoking and open flames are not permitted inside the venue.

  • Decorations must be approved prior to setup.

  • Glitter, confetti, and open alcohol containers are not allowed unless previously discussed.

  • Any damages caused by negligence or misconduct will be charged to the client’s account.

Governing Law & Dispute Resolution

All agreements and transactions with The Rose Garden are governed by the laws of the State of Texas.
In the event of a dispute, both parties agree to first attempt to resolve matters through direct communication and good-faith negotiation before pursuing formal legal action.

Disclaimer of Warranties

All services and products offered by The Rose Garden are provided “as is.” While we strive for excellence and satisfaction, we cannot guarantee outcomes based on external factors such as vendor performance, shipping delays, or dress alterations completed outside our supervision.
